Terms of Service

Welcome to Huddle. These Terms of Service ("Terms") govern your use of the Huddle mobile application and related services (the "Service"), operated by Hoang An Nguyen, Garnstraße 34, 14482 Potsdam, Germany ("we", "us", "our").

By creating an account or using Huddle, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Huddle. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian. We do not knowingly collect information from children under 13.

You must be a real person. Accounts operated by bots, scripts, or automated means are not permitted.

2. Your Account

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account and keep it up to date.

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately.

You may delete your account at any time through the app's profile settings. Upon deletion, your account data will be removed in accordance with our Privacy Policy.

3. How Huddle Works

Huddle allows you to create and join friend groups ("Huddles"). Within each Huddle, members record short video updates throughout a scheduled period (typically one week). Videos are revealed to all members at a designated time, but only members who have submitted their own video can view others' videos ("post-to-view").

Group administrators can configure settings such as video duration limits, schedule frequency, and reveal times.

4. Your Content

You retain ownership of the videos, comments, and other content you submit to Huddle ("Your Content"). By submitting content, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, transmit, and display Your Content solely for the purpose of operating and providing the Service.

This license includes the right to:

• Store and serve your videos to other members of your Huddles
• Generate thumbnails and process video for streaming
• Display your comments to other Huddle members

This license ends when you delete Your Content or your account, except where Your Content has been shared with others and they have not deleted it, or where retention is required by law.

You represent that you have all necessary rights to the content you submit and that Your Content does not violate any third party's rights or our Community Guidelines.

5. Acceptable Use

You agree to use Huddle in accordance with our Community Guidelines. You may not:

• Use the Service for any illegal purpose
• Upload content that is harmful, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate another person or misrepresent your identity
• Attempt to access other users' accounts or private data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to distribute spam, malware, or unsolicited content
• Scrape, crawl, or use automated means to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service

6. Intellectual Property

The Service, including its design, features, and technology, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

"Huddle" and associated branding are our trademarks. You may not use them without written permission.

7. Reporting and Enforcement

You can report content that violates these Terms or our Community Guidelines through the in-app reporting features or by contacting us at a.n.develops@gmail.com.

We reserve the right to remove content, suspend, or permanently ban accounts that violate these Terms. For severe violations (e.g., illegal content, child exploitation, threats of violence), accounts may be terminated immediately without prior warning.

8. Service Availability

We strive to keep Huddle available and functioning, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Service at any time.

We may release updates that you will need to install to continue using the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or 50 EUR, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

10. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
